Terms and Condition

1. Overview

This Terms of Service Agreement (“Agreement”) is entered into by and between Namelatype Foundry, located at Mertoyudan, Magelang, Central Java, Indonesia 56172, and you (“User” or “Customer”). This Agreement becomes effective upon your first use of https://namelatype.com/ (“Site”) or upon your electronic acceptance.

This Agreement governs your use of the Site and all products or services offered through it (collectively, the “Services”). By accessing or using the Site or purchasing Services, you acknowledge that you have read, understood, and agreed to be bound by this Agreement and our Privacy Policy.

References to “we,” “us,” or “our” refer to Namelatype Foundry Indonesia. References to “you,” “your,” “User,” or “Customer” refer to any individual or entity accepting this Agreement. No third-party rights are created under this Agreement.

We reserve the right, at our sole discretion, to update or amend this Agreement at any time. Changes are effective immediately once posted on the Site. Continued use of the Site or Services constitutes your acceptance of the updated terms.


2. Eligibility

Access to the Site and Services is limited to individuals who are legally capable of entering into binding contracts. By using the Site, you confirm that you:

  1. Are at least eighteen (18) years old;
  2. Have the legal capacity to enter binding agreements; and
  3. Are not prohibited from purchasing or receiving Services under the laws of Indonesia or any other jurisdiction.

If you are acting on behalf of a company or legal entity, you represent and warrant that you have the authority to bind that entity to this Agreement. If it is later determined that you lack such authority, you agree to be personally responsible for all obligations herein.


3. Rules of User Conduct

By using this Site, you agree that your activities will comply with this Agreement and all applicable laws. You may not use the Site in ways that:

  • Are unlawful or encourage illegal activities;
  • Promote child exploitation or pornography;
  • Encourage or engage in terrorism, violence, or harm to people, animals, or property;
  • Involve spam, hacking, or unauthorized access to networks;
  • Violate intellectual property rights of others;
  • Breach privacy, publicity, or confidentiality obligations;
  • Interfere with or disrupt the normal operation of the Site;
  • Upload or distribute harmful code such as viruses, worms, or Trojan horses.

Additionally, you may not:

  • Copy, reproduce, or distribute any part of the Site without prior written consent;
  • Alter or tamper with the Site or its technologies;
  • Access content or user data through unauthorized methods other than the Site’s official interface.


4. Intellectual Property

All content provided by Namelatype Foundry Indonesia, including but not limited to text, code, graphics, images, audio, video, APIs, trademarks, and logos (“Company Content”), is owned or licensed by Namelatype Foundry Indonesia and protected by applicable intellectual property laws.

You are granted a limited right to access and use the Company Content strictly for personal, non-commercial purposes. You may not copy, distribute, sell, license, or otherwise exploit any Company Content without prior written permission. No licenses or rights are granted to you by implication or otherwise.


5. Disclaimer of Warranties

Your use of the Site is at your own risk. The Site and Services are provided “as is,” “as available,” and “with all faults.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We make no guarantees regarding:

  • The accuracy or completeness of Site content;
  • The availability or accuracy of linked third-party websites;
  • The performance or reliability of Services.

No oral or written advice shall create any warranty. This disclaimer remains valid even after termination of this Agreement.


6. Limitation of Liability

Under no circumstances shall Namelatype Foundry Indonesia or its affiliates be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to:

  • Site content inaccuracies;
  • Linked third-party content or services;
  • Service interruptions;
  • Viruses or malware;
  • User-submitted content;
  • Any damages arising from use of the Site.

Any claim must be filed within one (1) year of its occurrence or it will be permanently barred.


7. Indemnity

You agree to indemnify and hold harmless Namelatype Foundry Indonesia, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Site;
  • Your breach of this Agreement;
  • Your violation of third-party rights.

This obligation survives termination of this Agreement.


8. Data Transfer

By using the Site, you acknowledge that data may be transferred across international borders, including to locations where our servers are hosted.


9. Availability of Website

We will make commercially reasonable efforts to keep the Site available 24/7. However, access may occasionally be interrupted due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or disruptions.


10. Discontinued Services

We reserve the right to suspend or discontinue any Service at any time, with or without notice. If discontinued, we may offer alternatives or refunds where applicable, but we are not liable for such changes.


11. Fees and Payments

All fees for Services must be paid at the time of purchase. Prices may be updated at our discretion and posted on the Site without prior notice. Refunds are governed by our Refund Policy.


12. No Third-Party Beneficiaries

This Agreement creates no rights for third parties.


13. Compliance with Local Laws

You are responsible for ensuring that your use of the Site complies with all local laws applicable in your jurisdiction.


14. Governing Law

This Agreement is governed by the laws of West Java, Indonesia, excluding conflict of law rules.


15. Resolution of Disputes

All disputes shall be resolved through binding arbitration in West Java, Indonesia. Claims must be brought individually and not consolidated with others.


16. Section Titles and Headings

Headings are for reference only and do not affect interpretation of this Agreement.


17. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.
